By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

The Site is intended to provide general information about our practice, services, and membership model.

2. NO MEDICAL ADVICE / NO EMERGENCY CARE

The content on this Site is for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

No Physician–Patient Relationship: Use of this Site, sending us a message through a form, or reading our content does not create a physician–patient relationship. A physician–patient relationship is only established when you are formally accepted as a patient, complete required intake/consent paperwork, and are notified of acceptance into the practice.

Emergency Situations: 3 Roots Concierge Medicine does not provide emergency medical services through this Site.
- If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room.
- Do not delay seeking medical advice or disregard professional medical guidance because of something you have read on this Site.

Always consult your own physician or qualified health provider with any questions you may have regarding a medical condition.

3. NOT HEALTH INSURANCE

3 Roots Concierge Medicine operates under a concierge / membership-based care model. Membership in our practice:

Is not health insurance.

Does not replace your health insurance or other coverage.

May not cover hospital services, specialist services, emergency room visits, urgent care, or other non-primary-care services.

You are responsible for maintaining appropriate health insurance coverage and for any costs not covered by your membership agreement and/or insurance, if applicable. Specific membership terms, fees, and coverage are governed by your Membership Agreement, which is separate from these Site Terms.

4. ELIGIBILITY & USE OF THE SITE

By using the Site, you represent and warrant that:

You are at least 18 years old, or using the Site under the supervision of a parent or legal guardian; and

You will use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

Use the Site in any way that violates any applicable federal, state, or local law or regulation.

Attempt to gain unauthorized access to any part of the Site, other accounts, or any servers or networks connected to the Site.

Use any automated means (bots, scraping tools, etc.) to access the Site for any purpose without our express written permission.

Introduce viruses, malware, or other harmful material.

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

If you become a patient, your health information may be protected under applicable privacy laws (such as HIPAA). Our use and disclosure of protected health information will be described in our Notice of Privacy Practices, provided to you as a patient and available in our office.

8. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, 3 ROOTS CONCIERGE MEDICINE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;

ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;

ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event shall 3 Roots Concierge Medicine, Dr. Alison Neff, or any of their officers, employees, contractors, or agents be liable for any:

To the extent any liability is found despite the foregoing, our total liability for any claim arising out of or relating to the Site shall not exceed one hundred U.S. dollars (US $100).

You agree to indemnify, defend, and hold harmless 3 Roots Concierge Medicine, Dr. Alison Neff, and their officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

Your violation of any rights of a third party.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any dispute or claim arising out of or relating to them, the Site, or any content shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

If we cannot resolve a dispute informally, submit to the exclusive jurisdiction of the state and federal courts located in or nearest to Warren County, Ohio.

12. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Changes are effective when posted, and your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
